Max already proved he can't. In these situations all you have to do is sit there and do nothing but listen. It's hard enough for most people to go to another person regardless of their relation to said person. Now if Minnie was constantly going to Max and dumping her problems in his lap then I could understand. If it's just a one off thing? Then Max handled the issue extremely poorly.
