Stop the Sex Offender Registry Insanity!

The real tragedy is that our country has a growing number of District Attorneys prosecuting cases with insane legal outcomes, especially in alleged consensual sex cases.

You may find this difficult to believe, I did at first, but there are kids as young as 10 on the sex offender registry for “playing doctor” no violence involved. Kids as young as 12 for pinching another kid on the butt just joking around, and a long list of teens and young men for “consensual sexual activity” as a result of girls who lied about their age and sought out sexual activity. And men for public urination on the golf course; how many men would this one put on the list.

How many people, including kids as young as 14, will we allow to be incarcerated, subjected to barbaric and abusive treatment (see Plethysmographs, Masturbatory Satiation, Arousal Reconditioning, Cognitive Restructuring of juveniles) and then forced to register as Sex Offenders for the rest of their lives before we bring an end to this insanity?

The current legislation, although very well intended, has seriously failed the true victims of violent sexual assault crimes and their families! And, it has resulted in what I believe were unintended consequences for potentially >95% of all youth and young adults who statistically could be convicted as sex offenders.

Please, join in the growing effort to immediately bring an end to this insanity before an entire generation is lost and registered as sex offenders. Legislators, please begin immediate changes to legislation to stop this insanity!

If anything, the sex offender registry is making our kids LESS safe.

Recently I consulted my local Serial Killer Registry and found out I'm living next door to a guy who killed three lunchroom ladies when they refused to give him seconds on the chili!

Oh please. I'm kidding. There's no registry of murderers out there. There's no armed robber registry either. Not even one for drunk drivers. No, the only easily available registry for all Americans to consult is the Sex Offender Registry.

Because ex-sex offenders are so much scarier than murderers?

No, the reason there's now a sex offender registry in every state--most of these lists dating back only to the 1990s--is that sex offenders have become the focus of intense parental fear. Who could blame us moms and dads, when we hear about kiddie kidnappings 24/7 on the news? The problem is not with nervous parents. The problem is with the registries. Turns out, they're worse than useless.

They are making our kids LESS safe. How? Well, there are three big problems with the registry.

1. The first is that we have not decided, as a country, which crimes we really want to see registered. And so, in five states, a man can end up on the registry for having sex with a prostitute. In 13 states, it is a registerable offense to urinate in public, and in 32 states, it's just as bad to be caught streaking. Yes, streaking. That means that when we look at a little map of our neighborhood and it's covered with red “Sex Offender” dots, there's often no way of telling whether the guy down the block is a child rapist or a jerk wearing a headband (and nothing else), bent on re-living the Carter years.

2.There are almost three quarters of a million people on the sex offender registries now. But according to a study done by the hardly soft-on-crime George Sex Offender Registration Review Board, only 5% of the 17,000 sex offenders in that state were “clearly dangerous” to children, and among them, only 100 could be classified as “predators.”

So here's an idea, says Adam Thierer, president of the Progress & Freedom Foundation, a market-oriented think tank: Why not make a “Scum of the Earth List” featuring only the scummy 5% and let the other 95% go streaking on their merry way? Save time! Save money! And, oh yeah: Save lives!

After all, maybe one of the reasons Jaycee Duggard was allegedly imprisoned for 18 years by a known sex offender was that an overburdened police force couldn't concentrate on creepy Phillip Garrido and the hut behind his house. They were too busy with the 100,000 other Californians on the registry.

This brings us to the third problem: The list keeps growing.

3. Perhaps the gravest danger posed by the Sex Offender Registry is how very easily your own child could end up on it. Consider the case of Ricky.

Ricky was 16 when he met a girl named Amanda at a teen club. She said she was about his age. They hit it off, started dating and ended up having sex, twice. A while later, Amanda ran away from home. When she thought the better of it, she went to the police. They questioned her and found out about Ricky.

Amanda, as it turns out, was only 13. So when the police tracked down Ricky and he admitted they'd had sex, he was arrested. Though Amanda's parents did not want to press charges, the district attorney did. In the end, Ricky took a plea to avoid jail time. Now he is registered as a sex offender. For life. There are thousands and thousands of teens like him on the list.

It is hard to get anything--an education, housing, job, even a pew in church (because offenders are forbidden to step foot anywhere children congregate)--when you're a registered offender.

An 18-year-old senior who has sex with his freshman girlfriend can end up on the list. A 19-year-old who sleeps with his underage sweetheart can end up there, too, even if they plan to get married. In a blink, boys go from normal, horny teens to official sex offenders on the registry--a registry that sounds so helpful.

But is all screwed up.

Internet reduces sex crimes

This seems in line with the research by Antony D'Amato, a lawyer and professor of law from the Northwestern Law School in Chicago, who found that since the Internet, the number of reported rapes have decreased. See his paper Porn Up, Rape Down

Remember that Internet porn was supposed to turn us all into rapist. Other reports have suggested the same, see the article on Slate.

And a contentious study from Switzerland recently found that people with prior child sex convictions who viewed child porn at home, were not a significant risk to kids (See Medical News Today)

It seems people prefer to get their rocks off at home.

Internet Porn is Not Associated with Social Harm

You're right. As Internet porn has proliferated, the U.S. sexual assault rate has declined, according to the FBI. This does not prove that Internet porn CAUSED the decline, just that there's an inverse association between the two. Still, many porn critics predicted that as Internet porn increased, the rape rate would explode. They have been proven wrong. Porn critics have also predicted that Internet porn would lead to an increase in sexual irresponsibility--abortions, STDs, and teen sex. But since porn became widely available for free on the Internet, we see fewer abortions, reduced rates of most STDs, and a lower rate of teen pregnancy, according to the CDC. Again, these are associations. There's no proof that porn CAUSES fewer abortions etc. But even if these associations are not causal, they clearly contradict what porn critics predicted. As far as social harm is concerned, porn critics are just plain wrong.

Predator Panic

This country has been embroiled in "Predator Panic" for over a decade, but little has truly been done to address the root causes of s*xual offending. Instead we've passed a myriad of feel-good, revenge oriented laws which have actually done more harm than good. I suggest reading the book "Once Fallen" to see the impact of the laws for yourself, available at the site www.oncefallen.com, which is also a great site for research on *ex offenders and the laws targeting them.

Double standard

Americans vigilantly police sex but exhalt violence. Slasher movies abound. Violence is mainstream. The article suggests an association between increased porn and decreased sex crime. The association for violent images and violent crime seems to be the reverse. Maybe these DAs ought to pursue the more dangerous threat instead of developing sound bytes for possible runs for public office.

I speak to my teenage son about the strange double standard of violence and sex in America. Parents will pitch a fit over a woman's neaked breasts in a fleeting shot in an action movie .. and let thir children view films dealing with mutilation of other for apparent pleasure.

Exactly who is feeding the major problem in contemporary society.

Sex laws have been built on

Sex laws have been built on misconceptions and myth.
The Supreme Court just ruled on sex offender laws where some factions of our government think by some inert reasoning that sex offender should be quarantined like some virus steaming from Draconian/Islamic radical view that sex offenders should be executed. I have seen for myself, video taken in another country where a sex offender was placed on a pole much like the Catholics use to use a pyramid shaped object and have them sit on it and spin, the pole travels through the body looking for the throat but if not found its ok because the sharpened end of the pole will come out somewhere to the delight of these very strange people who think such sad thoughts. The heritage of the act is in its self a brutal throwback to violent uneducated people who are so obsessed with any sex they can find & the only way to deal with this kind of "hierarchy" of historic hysteria. A word taken from hysterectomy, hysteria is tied to castration used to make animals less threatening which clearly explains the atmosphere we have made for our selves.
Anyway we are supposed to be the most advanced nation and we still have a death penalty when the rest of the world except for some nations we are still warring with, selling weapons too, {think!} while other nations went home our weapons dealers and torture lovers delighting in support for the death of people they don’t know or want to simply because they don’t know how to get money with out taking it from someone by force. Is that supposed to include mutilations? In my humble opinion that alone are terrorist activities as much as severed hands, ears, heads, or making a case with nothing more than an obsession justified by lies.
The truth about the sex offender registry will come out soon enough. When it does, People will see how the use of the registry was created, and by exactly who and why and the devastation it has created and the worthlessness of the use of it. It’s origin in the Jim Crow hanging laws that brought disgrace to our nation allowing thieves and murderous societal bigots who have trashed any shot at making good of a program in its design to make money destroying our nation and its people. We can not play god and we can not survive using this behavior model because we are compounding the problem since the numbers increasing to include the children they purport to protect.
It's a ruse designed by people who are getting rich off the doctoring, castration/hysterectomy/health care/physic care of people through sex laws that have gone wild. What about the people who are being used by the Medicare programs that requires these mutilations for both men and woman after they take their means of support? Digging around in someone’s genitalia because you want what a weaker nation? Can't you see? You have created the model and it is worthless! Why don't we just indiscriminately kill people we don't know? That is statically the next sex offender, because over 90% of all new offences are committed by someone “not” on the sex offender registry and the numbers are increasing not decreasing so as a behavior model this is really worthless.
So what is the use of such laws as the sex offender registry other than to terrorize people? With the murder of so many sex offenders and the continued disregard for life by the use of the registry it will be no time at all before the federal government will be held liable for their deaths through federal court.
In a nation where a statement may have a double or triple meaning and our entire linage can be traced through mud, guts, and beer it’s nice once in a while to get the picture of what is meant instead of what some thinks someone may have implied being translated by greed. So it is from the trenches to the hill. Remember the game where someone says something in someone’s ear then passes it the same way to the next; the person advocating such destructive laws are the ones who need to be section 8 by simple brake down of the issue not the sex offenders. Spendind lives fighting amongst THEMSELVES! over SEX!

Any act is debatable; astoundingly this has been allowed to go on this long. The disgust come from prejudice not even being able to discuss the issue by ones own internal wiring like a maze of mixed nerve ending unable to function, the mind shuts down unable to have empathy for the situation like any rational issue. We don’t even have laws that make since or definitions that work within those laws. We still want people to say they are mentally ill for having sex. Sex is nor will ever be the end of life in fact its necessary for our continued existence. The paradigm is better heard through the conflict of religions where people acutely kill one another over sex, but the message is the same. We have painted opinion with blood for far too long when the money is spent on punishment to the delight of the enforcers while the enforcers are exempt from their own laws which have no definition anymore. We still want people to say they are mentally ill for having sex, or not, when the inclination is to bow to authority sex often times becomes rape. I once had a woman ask if I was propositioning her by throwing pennies at her when I just wanted her to go away. Till we see its something like headaches/backaches too someone who has never had one, and once we have we start thinking allot about what really matters in life and how so many can spend OUR lives fighting amongst THEMSELVES over things that really don’t amount to a hill of frijoles. It is just a permanent under class designed by those who have been in control of everything for the wrong reasons too long.

More of the Same

Come on people, come down out of your ivory towers and look at the real world. The internet is a facilitator of meeting these children. For those of us who deal with the problem on a daily basis, your statistics don't help one bit.

We deal with predators everyday that perped when they were juveniles and then resumed their activities in their mid twenties.

You look down your noses at religion and make accusations against the victims and the ones that are on the front lines trying to rescue them, protect them or prevent another one from being brutally abused.

Dr. Phil ; my name is Mark Perk( I am in your viewer comments somewhere for our story) i saw your show on march 17, 2010 about the horrendous case of a small child raped by someone who was on the sex offender registry and the extensive damage he inflicted on the family and the whole tragic issue of sexual predators.

I am on the sex offender registry for having a consensual relationship with my now wife, in 1998.We now have two beautiful children.There is an answer to the question ",why cant the police watch these guys and prevent future horrors."?
The answer is not what people want to hear as this subject is driven by hysteria and knee jerk legislation to appease a roman colliseum, mob type mentality.

There are thousands and thousands of consensual,statutory cases on the sex offender registry in each state,Plus juvenille cases(19 year olds with 15 year olds) ,public nudity,exposure,prostitution,indecent behavior,public peeing etc.

There simply are not enough police to monitor all these cases. Because the states wont interject risk assessment hearings, all sex offender registrants are lumped together and there simply isnt enough police power to monitor all registrants,nor should they.!!!!!!!!
I have been on television numerous times on this subject. I know what i did is socially taboo and illegal, yet i am not a threat to children or women.To put me next to a child rapist on this list, is like putting a casual marijuanna smoker ,caught with a bag, in the same arena s a meth lab gangster!!!!!!!.

List of police time waisted on my case:
:ive been on this list for 11 plus years,ive had 100 plus probation appointments,40 plus home checks,done over 17 police station check ins,police monitoring our home frequently,pulled over (with my wife,both of us in cuffs)11 plus times etc.Stickers on our home on Halloween,lost 6 jobs,various acts of vigilantism etc.

We have had DCFS called on us 3 times by an anonynous neighbor because im on the list and have had numerous threatening calls to our home. Addittionally we have had to call the Crestwood Police and bother them numerous times because of suspicious cars in front of our home, snapping pictures,gawking etc.All this police time for one consensual case ,AND WE ARE MARRIED .!!!!
( We were married by the same judge who gave me the original misdimeanor,who did not consider me a threat!!! He later helped seal our case to "protect this family and the children" )

If the public is wondering why law enforcement cant even stop violent registered offenders from re-offending,the answer is that these predators are like a pin hiding in a haystack.The haystack is thousands of non violent cases like mine, that would be removed immediately if risk assessment was employed.

No media figure has the courage to tell it straight: time to weed out the predators from the registrants who simply broke the law. Then the police can triple their time up on monitoring violent offenders.( Its not the police who make these laws its the congressional and Governor wannabes,who want to appear to look "tough on crime.",yet have no clue of the ramifications of their legilation on families nor care.)

My husband is on the sex offender registry in Illinois, for 15 years for having a consensual reltionship with me ,his wife,when I was 16. He is lumped in with pedophiles,rapists and the worst kind of perverts. We have three children and my husband cant keep a job(he has a P.H.D),he cant pick up our kids from school,weve been thrown out of our home twice because we live by a school and police monitor our home. Why in Gods name isnt any commom sense prevailing around this issue and start letting people off the registry who are not a public threat? This is destroying our family,our childrens well being and my father in law( a decorated war veteran) has depleted his pension supporting us. We have testified before illinois congress,had several favorable artice on us from the Chicago Tribune, yet they wont let my husband Mark off the registry. He only has a misdimeanor for being with me,his devoted wife of 5 years now . we were married by the same judge,(Thomas E. Nowinski,) who gave Mark the misdimeanor. Please,please someone help us. Neighbors stare at our home,people think a rapist lives in the home. Marks oldest son(from a previous marriage) was assaulted in Hyde Park,defending Mark from fellow classmates calling Mark a rapist!! This is ruining my childrens welfare and I ,the"victim" am begging some one to take his name off the sex offender registry!!. Police Task Force for Internet Sex Crimes

I just read the article and above comments, and strongly disagree with the insanity that's happening with alleged "sex offenders".

The insanity is not limited to the registry, however. It's taking proportions which look more like a remake of Minority Report than an honest and actual attempt to catch the real predators.

Since a few years, task forces have been formed by the police in 39 states with the specific purpose to entice and lure "sex offenders" to have sex with 12-14 year olds. Using public or social networks such as MySpace or Craigslist, these task forces place ads by "mothers" offering their minor "daughters" up for sex. Those who respond to such ads are then step by step lured into traveling to see the "daughter" to have sex. Usually this occurs through email correspondence with the persons who respond to the ad.

The emails of the "mother" are pretty graphic and persuasive, offering to buy condoms, telling the person that they're both "showered and ready" and "when are you coming? We're waiting for you...", etc. When the person shows up at the front door, no young girl or mother are coming at the door, but 4 burly police detectives arresting the "offender."

Among the victims of this sting are guys who've never done a thing like this before and were simply curious, or maybe did want to have just sex. In other words, not even the predator types.

And what was the guy REALLY guilty of? No ACT was committed, just an intent to have sex. But that's unfortunately how the laws in these 39 states are constructed -- he's not guilty of actually having committed the or any act, he's guilty of an intent. All he did was emailing a "mother" who wasn't a mother, and a "daughter" who was a 43 year old male detective. So even if the respondent wanted to have sex, he couldn't have gotten it.

Entrapment? Not per the law. The police apparently can freely commit the ACTUAL crime of offering a 14-year old girl up for sex and risk to attract real predators to an otherwise quiet community in the hope to arrest them. Is this insane or what?

These task forces are mainly formed by police in rural areas. From the list of towns and counties with task forces, they exist in places such as Milford Connecticut, Washoe County Nevada or Gonzales, Louisiana--not downtown LA, east-side Chicago or inner city New York where you would think 14 year olds would really be at risk.

How many 12 or 14-year olds were abused in Oconomowoc, Wisconsin to merit a special task force of local police to lure predators into their innocent communities intending to commit sex with a minor?

This is not only ludicrous, it's DANGEROUS.

What would happen if a real predator comes in response to an ad on Craigslist, sees a 12-year old in the street coming from school and rapes her instead of the fake "daughter"? Who would REALLY be responsible for such a crime?

It would be the equivalent of setting up a crack house in the middle of Oconomowoc and inviting all the drug dealers to cross state lines and come over to buy crack. Who's at risk here? CERTAINLY the community!

I think, apart from living in a crazy legal system where a man can go to jail for a consensual relationship when he was 16 years old (and marries her afterwards)and carry the stigma of "sex offender" forever, these task forces are not only a real stupid and expensive solution to a non-existing problem, they're exposing their communities to unnecessary dangers if the real predators show up in response to their ads.

I have two daughters myself and shudder at the idea that the local police is trying to lure sex offenders to my community.

No, this insanity has got to stop.
